PAYMENT, CANCELLATION, RETURN AND REFUND POLICY

1.1. Sales & Ordering

• You hereby confirm that any products you purchase from NGP Solution is only for your internal consumption and strictly not for resale. NGP Solutions accept orders both through online and offline means, with purchase orders (PO) process; all terms and conditions regardless of the means remain constant and unchanged.
• Orders once placed cannot be cancelled after the products / Services are shipped / implemented.
• You agree and acknowledge that any part which is ordered by You as a custom build and specific to a project are strictly under non-cancellable and non-return (NCNR) basis.
• You agree and acknowledge that orders which are executed under Hi-Sea sales, bonded warehouse sale or any mode of duties and taxes exemptions are not under any circumstance eligible for cancellation.
• You agree and acknowledge that any and all export orders whether ordered through online means or offline means or by a PO process are not under any circumstance eligible for cancellation.
• Any orders shipped out of India will not be eligible for any kind of returns or refunds.
• Any orders placed by you on with NGP Solutions, is an indent for NGP Solutions to procure the relevant products / services including from third parties and have them delivered to you.

1.2. Pricing and availability

• The pricing and any discounts displayed or offered by NGP Solutions is governed and solely determined by NGP Solutions. The underlying factors in such determination are based on market forces, the availability of products and various other factors as determined by NGP Solutions. NGP Solutions reserves its right to add, modify or revise the terms at its discretion such as providing cashback offers, reward points, vary the discount purchase, offer to buyback products etc. NGP Solutions can at its sole discretion withdraw any such offer, discount or any other benefit provided without Your consent.
• The availability of the products / services by NGP Solutions displayed on their website at www.ngpsolutions.co or communicated either in writing or orally by NGP Solutions or a third party engaged by it, including around price, delivery timelines, the quantity are estimates only and subject to change and variations. Any change will be duly notified via email or SMS, prior to being accepted.

1.3. Invoicing and Taxes

• NGP Solutions will take up orders on the basis of POs generated by You or through an order placed on the website of NGP Solutions, www.ngpsolutions.co. Once a PO is accepted, a relevant invoice will be generated against the said PO which will be placed before You. The invoice will indicate a relevant break-up of the price of the product, other costs and applicable GST, taxes and levies which are not revisable.
• In the event that You seek to obtain tax credits, You are required to provide all the appropriate tax registration details to NGP Solutions prior to raising a PO. You hereby agree and acknowledge NGP Solutions that NGP Solutions is facilitating Tax Credits to be received by you and that NGP Solutions shall not be liable for any claims of loss of tax credit by You under any circumstance.

1.4. Payments and Credit Facility

• You undertake to honour the payments made to NGP Solutions including while being made through third party agents on the website of NGP Solutions, while purchasing products or services. At no point of time, you shall reverse any payments that are already made to NGP Solutions, by way of claiming it through the payment gateway or any other channel.
• NGP Solutions offers credit terms to its customers at its sole discretion basis payment timelines, and such other factors as decided from time to time. Any change to the credits terms will be at the discretion of NGP Solutions..
• The credit facility offered by NGP Solutions, is an earnest effort from NGP Solutions to provide you with additional payment options including through any partnering ‘Credit Agencies’.
• NGP Solutions may choose to offer you a credit period either directly or refer You to its partnering Credit Agencies, who at their discretion will approve a credit limit for You, after going through a verification process. You undertake to use such credit approvals exclusively for NGP Solution only.
• NGP Solutions does not guarantee the Credit approvals for you. You agree and acknowledge that NGP Solutions and any partnering Credit Agencies may at their sole discretion revoke the credit limits at any given point of time based on discrepancies found in the information provided by You, or defaults committed in the repayment timelines.

2.1. Cancellation

You can cancel an order prior to NGP Solutions agreeing to provide the Product within 5 hours from issue of a PO. However, once NGP Solutions has accepted a PO and issued a sales order, cancellation of such order is not accepted.

2.2. Return and Refund

Any return of products shall be within the specified return window timelines as set out below:

• Return request or refund request can be initiated with NGP Solutions by You (the customer) within 3 days from the date of receipt of goods by You, under no circumstance shall a return request be accepted if such request is raised after 3 days from the date of receipt of goods. All goods must be returned to the following address.

  PROVIDED THAT RETURN OF A PRODUCT WILL BE CONSIDERED ONLY IF THE PRODUCT IS RECEIVED IN A PHYSICALLY DAMAGED CONDITION, OR ANY PARTS AND ACCESSORIES ARE MISSING OR IF THEY ARE DIFFERENT FROM THE PART, NUMBERS, AS SUPPLIED BY NGP SOLUTIONS.

• If you wish to return any product due to any defect or non-performance, the reason for such return should be clearly mentioned, and NGP Solutions will have to duly investigate the same by undertaking an inspection and usage of the product. You agree to provide all reasonable assistance, cooperation, access to data and Your premises in this regard. Basis such inspection and evaluation, NGP Solutions will provide you with a decision.
• Return requests will be accepted and processed only if:
  • The product is in the original condition, along with the box, tags, spares and accessories (if any) as shipped by NGP Solutions or a third party acting on behalf of NGP Solutions.
  • It is established that the damage (if applicable) is not inflicted while at your possession.
  • The product is different from what was described in the Invoice.
  • The product page does not carry an explicit sign of “Non-Returnable Product” on the website or at the time of placing the order.
  • The reason for return is not based on your buying remorse.
• Upon Successful acceptance of a Return Request, NGP Solutions shall (as applicable):
  • Initiate a refund of Your payment if made through a Payment Gateway.
  • Initiate the Reversal to Credit Limit if purchased through the Credit Option.
  • Reverse the Tax Credits if any by way of issuing Credit Notes; or
  • Provide you with a replacement product after a period of 15 days but no later than a period of 30 days.
